Terms of Service

These terms are written in plain language and describe how we normally work. For any specific project, the quote, proposal, or contract you agree to with us takes priority where the two differ.

Our services

Fortune Dev Solutions provides web and app development, UI/UX design, brand identity, and related digital services. The scope, timeline, and price of your project are agreed in writing before work begins, and changes to scope are agreed the same way.

Payments and ownership

Invoices are due on the schedule set out in your quote. Once a project's invoices are fully paid, you own the final deliverables created specifically for you; until then we keep ownership of the work. Unless we agree otherwise in writing, we may feature non-confidential work in our portfolio.

Confidentiality

We keep your business information confidential and do not share it outside the project, except where the law requires it or a service provider we work with (for example, hosting or payment platforms) needs it to do their part of the job.

Third-party services

Projects may depend on third-party platforms such as hosting, M-Pesa, or other APIs. Their pricing, availability, and terms are outside our control, though we will flag anything that affects your project.

Liability

To the extent the law allows, our liability for any claim connected to a project is limited to the fees you paid us for that project. We are not liable for indirect or consequential losses.

Governing law

These terms are governed by the laws of Kenya.
